Legal Status in New Brunswick
Under section 38 of New Brunswick’s Fish and Wildlife Act, native wildlife can’t be collected or kept in captivity. Keeping exotic wildlife is also restricted: section 38.1 of the Act prohibits the importation or keeping of wildlife without a permit, with some exceptions. Those exceptions are set out in Regulation 92-74. The only garter snake on that list is the Peninsular Ribbon Snake, Thamnophis sauritus sackenii. (The Brown Water Snake, Nerodia taxispilota, is also exempt. Why these two, I have no idea.) So far I have been unable to find any information on how to apply for a permit.
The keeping of native and exotic wildlife may be subject to local by-laws and ordinances, as well as other laws at the provincial or federal level not mentioned here. This page is not a definitive source. Please consult the authorities in your area.
